Terms of Service

Version 1.3 — effective 24 August 2026

These terms govern Emblemry's website and badge-generation service. By asking Emblemry to generate a badge, creating an account, or buying or using credits, you agree to the parts of these terms that apply to that feature.

1. The service provider

Emblemry is operated by Malte Hedderich. The full address and legal contact details are in the Imprint. Use the contact page for product support, moderation, removal, and redress requests.

2. Who may use Emblemry

You must have the legal capacity to enter these terms. If the law where you live requires a parent or guardian to act or consent for you, you may use Emblemry only with that involvement. Emblemry does not verify age unless a feature says otherwise.

If you use Emblemry for an organisation, you confirm that you may accept these terms and grant the necessary rights for that organisation.

3. Free badges

The free service lets a visitor request one standard badge at a time from the global daily pool shown on the site.

A free badge is public by design. If it is generated and passes publication review, Emblemry may place its image and selected brief details at a public, shareable address and in the gallery. Anyone may download and reuse it under the Badge License. There is no private free mode, and a released free badge does not become private after sign-in.

The pool is shared by all visitors and refills at the time shown on the site. A submission does not reserve a place until the service completes its transactional claim. Emblemry may change the pool size or refill schedule prospectively.

Submitting a brief does not guarantee acceptance, generation, publication, delivery, continued hosting, or a place in the gallery. If publication review is unavailable, uncertain, or negative, the free badge image is not delivered or listed. The existing creation-status page may still show the badge title, status, grounds, and redress information, but it does not serve the image or public provenance. Its place in the free pool remains spent. You may ask for human review through the contact page.

4. Accounts and sign-in

Paid and private features require an Emblemry account. Sign-in is provided through Firebase Authentication using Google or Apple. The identity provider's terms also apply to your use of its sign-in service.

You are responsible for controlling access to your Google or Apple account and for signing out on a shared device. Tell Emblemry promptly if you believe somebody has accessed your Emblemry account without permission.

An account can hold private badges, runs, credits, purchase records, acceptance records, and service settings. Emblemry does not create public maker profiles.

The account menu lets you export your product data, reach cookie and tracking settings, and delete the account. Account deletion removes the Firebase account, private badges, ordinary product data, and unused credits. It does not create a voluntary refund unless mandatory law requires one. Limited billing, fraud, security, and legal-claim records may remain where the law or a legitimate claim requires them. A public badge remains public after account deletion unless you separately request removal and Emblemry can reasonably verify the request.

5. Credits and paid work

Credits are sold in one-time packs. They are not a subscription. Credits belong to the account, do not expire while it exists, and end when it is deleted.

One credit pays for one delivered standard badge. Credits buy private delivery, not access to extra styles. Every style available for a paid standard badge is also available on the free path.

Paid badges are private. They do not appear in the gallery, do not create a public profile, and are not licensed to gallery visitors. The service shows the credit cost before you start a run.

Credits are held when a paid run starts. A held credit is deducted only for a badge Emblemry delivers. Credits for an item that is skipped, cancelled before delivery, or not delivered after the permitted retries are released back to the account. Provider retries do not cost another credit.

6. Checkout, tax, and invoices

Polar Software Inc. acts as merchant of record for credit purchases. Polar is the seller in the checkout transaction, collects payment, calculates and remits applicable transaction taxes, performs fraud checks, and provides the receipt or invoice. Polar's entity, currency, gross price, tax treatment, payment methods, and Checkout Buyer Terms shown at checkout apply to that purchase.

Emblemry does not operate a recurring subscription and does not charge a card automatically for another credit pack.

Credit-pack prices are in euros and include applicable VAT or similar transaction tax. Polar displays the final total before the order is placed. Business tax details, including a VAT number where supported, must be entered in Polar's checkout. Polar determines whether a reverse-charge or other tax treatment is available. You can open the Polar-issued invoice from purchase history; Emblemry asks Polar to generate it on demand if it is not ready yet.

Emblemry records the purchased credit lot and the price actually paid. This lets the service grant credits once, reconcile refunds, and avoid refunding the same purchase twice.

7. Withdrawal and refunds

Mandatory consumer rights remain unaffected. The applicable withdrawal information and Polar buyer terms are shown before purchase and linked from the service.

Before Polar's checkout opens, Emblemry's own purchase screen asks for your express request for early performance and acknowledgement of the legal consequence. The box is not preselected. Buying or using a credit by itself is not treated as that acknowledgement.

For fourteen days after a purchase, the right to withdraw is lost for each credit already spent, while credits from that purchase that remain unspent are refundable at the per-credit price paid for that purchase.

Emblemry does not promise a voluntary refund beyond rights required by law. Releasing a held credit because Emblemry did not deliver a badge is account correction, not a cash refund.

If Emblemry permanently discontinues the paid service, it will refund the unused value of purchased credits. The refund is calculated from each remaining credit's purchase-lot provenance and the price actually paid for that lot. Free, promotional, already spent, or deleted credits have no refundable purchase value. Emblemry will arrange the refund by transfer, subject to mandatory law and reasonable payment-method constraints.

8. Your submissions

You retain any rights you have in text or other material you submit. You give Emblemry a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, adapt for prompting and layout, process, moderate, generate from, and display that material as needed to provide, secure, and enforce the service.

For a public free badge, the licence also permits Emblemry to publish, cache, distribute, and grant the public licence described on the Badge License. This permission lasts while Emblemry hosts the public badge and as needed to respect licences already granted, legal duties, and legal claims.

For private paid work, Emblemry uses the material only to operate, secure, support, and enforce the private service. Private status does not stop processing by Emblemry, OpenAI, Google Cloud, Cloudflare, and other necessary providers.

You must have the rights and authority needed to submit the material and grant these permissions. Do not submit:

  • personal or sensitive data about yourself or another person;
  • confidential information, trade secrets, credentials, or private communications;
  • material that infringes copyright, trade mark, privacy, publicity, or other rights;
  • instructions to reproduce an existing work, logo, coat of arms, credential, or protected design exactly; or
  • material prohibited by Emblemry's service rules or applicable law.

Every submitted value is treated as data, not as an instruction to change how Emblemry or its models operate.

9. AI generation and moderation

Every badge is generated by machine. AI output can be inaccurate, culturally inappropriate, non-unique, similar to existing material, or unsuitable for your intended use. Emblemry does not promise that an output is original, copyrightable, exclusive, factually correct, or free of third-party rights.

You must review a badge before using it, especially for trade marks, protected symbols, official appearance, personal rights, safety-critical use, or a commercial campaign. Emblemry does not clear rights for you.

Emblemry uses three distinct controls:

  1. A suitability check reviews the brief before generation or a credit hold.
  2. The image provider applies its own content moderation during generation.
  3. A publication review checks the finished free badge before it becomes public. Private paid badges skip this public-gallery review.

Emblemry may refuse a brief, retry generation, withhold a free badge, remove a public badge, or restrict an account to enforce its service rules, protect the service, respond to a valid notice, or comply with law. These controls are not a promise that every problem will be detected.

You may correct and resubmit a brief after a suitability rejection. If a publication decision or later moderation action appears wrong, use the contact page to request human review. A report by itself does not automatically remove a badge.

10. Badge rights

The Badge License is part of these terms and explains the permissions for delivered files.

In short:

  • a public free badge is available to everyone for personal and commercial use, modification, and redistribution, with the required “Created with Emblemry” attribution;
  • a private paid badge is licensed broadly to the account holder for personal and commercial use, modification, distribution, and incorporation into other work, with no attribution requirement; and
  • both licences are non-exclusive and limited to rights Emblemry can lawfully grant.

The licence does not grant a trade mark, endorsement, right in the submitted subject, or permission from a third-party rights holder.

11. Public removal

A creator or rights holder may request removal of a public badge through the contact page. Emblemry may ask for proportionate information to verify the request.

Removal stops future hosting and distribution by Emblemry. It does not recall files already downloaded or copied, remove third-party caches and posts, or revoke public badge licences already granted, except where mandatory law or the rights in question require another result.

12. Privacy, cookies, and essential service messages

The Privacy Policy explains how Emblemry handles personal data. The Cookie Policy explains necessary browser storage and the separate opt-in for analytics storage. Emblemry may send essential messages about purchases, refunds, exports, account security, or legal rights. It does not use those messages for marketing.

Polar's Checkout Buyer Terms govern the separate checkout transaction with Polar as merchant of record.

13. Availability and changes

Generation depends on external AI and cloud providers. It can take time and can fail. Runs may continue after you close the browser. Emblemry does not promise uninterrupted availability, a service-level agreement, a particular model, a particular generation time, or permanent availability of a free feature.

Emblemry may change styles, models, limits, and service features. Material term changes apply prospectively and do not remove mandatory rights.

Emblemry may suspend or discontinue the service. If it permanently discontinues the paid service, the unused-credit refund rule in section 7 applies.

14. Suspension and termination

You may stop using Emblemry at any time.

Emblemry may suspend access or remove content where reasonably necessary for a serious or repeated breach, fraud, security, legal compliance, or protection of other users and the service. Where appropriate, Emblemry will give notice and a chance to correct or object. Mandatory rights remain unaffected.

15. Liability

Emblemry is liable without limit for intent, gross negligence, injury to life, body or health, fraudulently concealed defects, an expressly assumed guarantee, and liability that cannot be limited by law, including applicable product-liability law.

For slight negligence, Emblemry is liable only for breach of an essential contractual duty whose performance makes the contract possible and on which you may ordinarily rely. In that case, liability is limited to the damage that was foreseeable when the contract was made. These limits also apply to Emblemry's agents and representatives.

Nothing in these terms excludes a mandatory consumer warranty, remedy, or burden of proof.

16. Governing law and disputes

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections of the country where you usually live.

Statutory rules determine the competent court. Emblemry does not link to the former EU Online Dispute Resolution platform, which has closed. Any legally required consumer-dispute statement appears in the Imprint.

17. Changes to these terms

The version and effective date appear at the top. Updated terms apply to future use after their effective date. Where a change materially affects a legal right, Emblemry will give reasonable advance notice through the service unless an urgent legal or security change requires faster action.
